Saudi Arabia Takes Strategic Steps to Strengthen its Arbitration Ecosystem
With the recent approval of a Council of Ministers Resolution, Saudi Arabia is making a decisive move to enhance its arbitration and alternative dispute resolution (ADR) ecosystem. The initiative seeks to align the Kingdom with international best practices and establish it as a mature, reliable, and globally competitive seat for arbitration.
Promoted in collaboration with the Saudi Center for Commercial Arbitration (SCCA), the Resolution introduces a series of legislative, judicial, and executive measures aimed at boosting the arbitration sector and fostering a transparent, efficient, and investor-friendly environment.
A Multilevel and Integrated Approach
Among the key initiatives, the National Competitiveness Center (NCC) – in cooperation with the Ministry of Commerce, Ministry of Investment, Ministry of Justice, and SCCA – will review the current Arbitration Law and its Implementing Regulations, with a view to identifying updates aligned with global standards.
Another crucial element is the integration of public institutions with the Saudi arbitration ecosystem through digital platforms. The aim is to ensure access to government e-services and improve the administrative efficiency of arbitration proceedings.
Transparency, Training, and Promotion
The Resolution also promotes the translation and publication of key judicial rulings related to arbitration, increasing legal predictability and transparency for international stakeholders. Additionally, a study will be conducted to assess global perceptions of arbitration practices in Saudi Arabia, focusing on the quality of processes and outcomes.
Saudi universities and research institutions are encouraged to undertake applied and statistical research in the field, while arbitral institutions operating in the Kingdom are invited to organize professional events, engage in international forums, and publish sectoral guidelines and insights.
A Shared Vision for a More Competitive System
Dr. Walid Abanumay, Chairman of SCCA, emphasized that the initiative reflects a structured and collaborative national effort to develop effective dispute resolution mechanisms in Saudi Arabia through targeted legal and institutional reforms.
Dr. Hamed Merah, SCCA CEO, also highlighted the importance of coordinated efforts among judicial, governmental, and academic entities in creating a supportive environment for the sustainable growth of arbitration and ADR across the Kingdom.
